An inquisitorial process of dispute resolution requires good investigative skills. The process of investigation requires a good understanding of the elements of the claim and defence, a good understanding of the distinction between facts and evidence, an ability to organize facts and evidence into a coherent framework, and the ability to direct questioning and the gathering of evidence based on the facts and evidence. An inquisitorial process in the absence of advocates requires additional skills of interviewing and interrogation in such a manner as to obtain objective facts, while seeking verification and corroboration of those facts. Questioning skills are key.
This workshop will explain the inquisitorial process and equip participants with the skills needed to run a hearing in an efficient and effective manner to obtain all the relevant and available information required to make a decision.
